Terms & Conditions

1. Scope

The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that cannot be predominantly attributed to his or her commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they only become part of the contract if we have expressly agreed to this.

2. Contracting Party, Conclusion of Contract, Correction Options

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You can first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking on the order button, you submit a binding offer for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent.

We will accept your offer within two days by

  • we submit a declaration of acceptance in a separate e-mail, or
  • where applicable, the payment transaction is carried out by our service provider or the selected payment service provider. The time of execution of the payment transaction depends on the selected payment method (see "Payment").

The alternative that is relevant to you depends on which of the listed events occurs first.

By placing your order, you give us a SEPA direct debit mandate. We will inform you of the date of debiting your account at least one banking day in advance (so-called "  debit card").Prenotification). A banking day is any working day with the exception of Saturdays, national public holidays, and December 24 and 31 of each year. The account will be debited after the goods have been shipped. 

Amazon PayIn order to be able to pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. 6. Right of revocation

7. Retention of Title

8. Damage in transit

The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such errors to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance company.

9. Warranties and Guarantees

9.1 Liability for defects

Unless expressly agreed otherwise, the statutory law on liability for defects applies.

The following limitations and shortened deadlines do not apply to claims based on damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health
  • in the event of an intentional or grossly negligent breach of duty or fraudulent intent
  • in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

Restrictions on entrepreneurs

In the case of entrepreneurs, only our own information and the manufacturer's product descriptions, which have been included in the contract, are considered to be an agreement on the quality of the goods; We assume no liability for public statements by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The preceding sentence does not apply to an object which has been used for a building in accordance with its usual mode of use and which has caused its defectiveness. The sale of used goods is subject to the exclusion of any warranty.

The statutory limitation periods for the right of recourse pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.

Regulations vis-à-vis merchants

Among merchants, the duty to investigate and file a complaint regulated in Section 377 of the German Commercial Code (HGB) applies. If you fail to make the notification stipulated therein, the goods shall be deemed to have been approved, unless it is a defect that was not apparent during the inspection. This does not apply if we have fraudulently concealed a defect.

We would like to inform you that we may shorten the limitation period for the sale of used goods to consumers to one year from the date of delivery of the goods, provided that we inform you specifically of this and this is expressly and separately agreed.

 

9.2 Warranties and Customer Service

10. Liability

For claims due to damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in case of injury to life, limb or health,
  • in the event of an intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability is limited to the amount of the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. In all other respects, claims for damages are excluded.

11. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR), which you  can find here. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. Protection of minors

To the extent that your order includes goods the sale of which is subject to age restrictions, we will ensure that the purchaser has reached the required minimum age by using a reliable process that includes personal identity and age verification. The delivery person will only hand over the goods after the age verification has been carried out and only to the customer personally. In this case, delivery to packing stations is not possible.

13. Final Provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, our place of business is the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you.
